DomeneConnect.no Terms of Service

DomeneConnect.no, a division of Portalen Gruppen AS (DUNS number 899 551 222), agrees to provide and customer agrees to purchase the services requested by the customer from the website, in email, or in writing. The customer may add services via any of these 3 methods and agrees to pay in advance for them, whether they be one-time charges or recurring monthly fees.

Changes

No changes to this agreement shall be binding except those in writing counter-executed by both parties. Deviations in pricing shall be agreed to in writing. Email confirmed by both parties shall suffice.

Invoices, Payment

DomeneConnect.no will invoice the Customer for Fees and Expenses monthly; provided, however, that DomeneConnect.no may invoice the Customer for Fees and Expenses associated with Service(s) provided pursuant to a customer request immediately upon DomeneConnect.no’s provision of such Service(s). The customer acknowledges that DomeneConnect.no will invoice certain Service(s) (including without limitation telecommunications services) in advance of the provision of such Service(s). Payment shall be due immediately upon the invoice date for recurring monthly services whether or not the customer has received an invoice yet or not.

Subscription and Automatic Renewal: All services provided by DomeneConnect.no are offered as automatically renewing subscriptions. This means that unless the Customer notifies DomeneConnect.no of their intent to cancel the service before the end of the current subscription period, the service will automatically renew, and the Customer’s account will be charged for the next billing cycle. Cancellation requests can be made by contacting our support team in writing. Customers will receive a confirmation upon successful processing of their cancellation request.

Invoices which remain unpaid ten (10) days after receipt by the Customer shall incur a late fee of 10%. In instances of high service usage or as determined by risk assessment, DomeneConnect.no reserves the right to suspend or terminate services prior to the 30-day mark. This is to mitigate potential risks associated with extended credit for high-usage accounts. In all cases, service may be terminated for non-payment after 30 days at DomeneConnect.no’s discretion.

Expenses shall be included on an invoice only to the extent that the actual amount of Expenses is known to DomeneConnect.no at the time the invoice is issued, and Expenses for which an actual amount is not known to DomeneConnect.no at the time an invoice is issued may be included on subsequent invoices. Unless otherwise agreed in writing by the Parties, the failure of DomeneConnect.no to include earned or incurred Fees or Expenses on a given invoice shall not relieve Customer of its obligation to pay such Fees or Expenses. Customer’s obligation to pay Fees or Expenses shall survive the termination of this Agreement for any reason whatsoever.

Monthly Pre-Payment Requirement: Customers are required to pre-pay the fixed monthly charge for the services provided by DomeneConnect.no. This pre-payment must be made before the commencement of the service period.

Additional Fees and Expenses: Any additional fees and expenses incurred beyond the fixed monthly charge, including but not limited to overages and special service requests, will be invoiced separately and are payable as per the terms specified in each invoice.

Restriction on Transfer due to Unpaid Invoices: The Customer acknowledges and agrees that if there are any outstanding invoices or unpaid balances owed to DomeneConnect.no, the Customer will not have the right to transfer their website or any related services away from DomeneConnect.no’s hosting environment. This includes, but is not limited to, the transfer of domain names, website data, databases, and associated content.

Resolution of Outstanding Balances: Prior to any transfer of the website or services, all outstanding balances must be fully paid and cleared. DomeneConnect.no reserves the right to withhold access to, or the transfer of, any Customer data or services until full payment of the outstanding amount is received.

Notification of Intent to Transfer: In the event that the Customer wishes to transfer their website or services to another provider, the Customer must notify DomeneConnect.no in writing. This notification must be accompanied by a plan to settle any outstanding balances.

Release of Data Post Payment: Upon receipt of full payment of all outstanding invoices and balances, DomeneConnect.no will agree to the transfer of the Customer’s website and services in a timely manner, subject to the terms and conditions of this Agreement.

Liability for Continued Hosting Costs: In the event that the Customer transfers their website or services without DomeneConnect.no’s explicit consent and while having outstanding payments, the Customer shall remain liable for ongoing hosting costs. These costs will accrue until all outstanding invoices are fully paid, including those under dispute. If a transfer occurs under these circumstances, the Customer will be held financially responsible for any costs incurred by DomeneConnect.no as a result of such unauthorized transfer. This includes, but is not limited to, loss of revenue, legal costs, and any other expenses related to the recovery of owed payments. DomeneConnect.no reserves the right to take appropriate legal action to recover owed amounts and to enforce the terms of this Agreement. This may include initiating legal proceedings and seeking compensation for any additional costs associated with the unauthorized transfer and recovery of payments.

Dispute Resolution: In cases of disputed charges, the Customer must address such disputes in accordance with the dispute resolution procedures set forth in this Agreement prior to initiating a transfer. However, the initiation of a dispute resolution process does not exempt the Customer from the restriction on transfer for outstanding payments.

Notification Requirement: The Customer is required to notify DomeneConnect.no immediately upon any intended or completed transfer of servic. Failure to do so may result in additional penalties and enforcement actions.

Refunds and Cancellation

All payments to DomeneConnect.no are nonrefundable. This includes one-time setup fees and subsequent charges regardless of usage. Service continues until the end of the paid period.

Cancellation requests must and may only be submitted via our support page at https://DomeneConnect.no/support/.

Cancellation requests are not accepted through phone, email, fax, or any other method besides through sending a cancellation request via our support page at https://DomeneConnect.no/support/. You must have all account information to cancel an account. Only the authorized account holder may cancel the account. All past due invoices must be paid before a cancellation request may be processed and before the website can be migrated to another hosting provider.

Customers wishing to cancel their service with DomeneConnect.no must submit notice of cancellation thirty (30) days prior to their next automatic renewal renewal date. If notice of cancellation is not submitted at least seven (30) days prior to the next renewal date, the customer is responsible for payment of the next billing period.

Overage Charges

Visits Overages

Customer agrees that advertised visits allowances represent the sum of the visitors included in the package price. Customer agrees that the sum of visitors usage that exceeds the allowance shall be billed at $2.00 per 1000 additional visits.

Disk Space Overages

Customer agrees that advertised disk space allowances represent the sum of the storage included in the package price. Customer agrees that the sum of storage usage that exceeds the allowance shall be billed at $4.00 per Gigabyte additional disk space.

Bandwidth Overages

Customer agrees that advertised bandwidth allowances represent the sum of the incoming and outgoing allowances. Customer agrees that the sum of incoming and outgoing bandwidth usage that exceeds the allowance shall be billed at $0.5 per Gigabyte additional bandwidth.

Payment for Resource Usage Exceeding the Cap

Additional resources provided by DomeneConnect are subject to a monthly cap of USD 1,000, unless a different arrangement is agreed upon in writing between the Customer and DomeneConnect. In the event that the Customer’s usage of resources exceeds this cap, the Customer agrees to make an advance payment for the estimated additional resource usage. This payment must be made immediately upon receiving notification from DomeneConnect that the estimated usage exceeds the cap. DomeneConnect will provide a detailed forecast of the expected additional usage and the associated costs. Failure to make this advance payment may result in a temporary suspension of the additional resources until payment is received.

Term

The term of this Agreement shall begin upon the date the package is purchased and made available to the customer and shall be for 1 month and shall renew for successive 1-month terms until terminated by either Party upon the sooner of (i) thirty (30) days prior written notice to the other Party, or (ii) the expiration or termination of all Service(s) set forth in the Statement of Work and all Work Order(s).

Termination Due to Breach

In the event that the Customer commits a material breach of any of its obligations under this Agreement, DomeneConnect.no may terminate this Agreement or (at DomeneConnect.no’s sole option) suspend, interrupt, or terminate one or more Service(s) to which such breach pertains by sending written notice of termination to the Customer with termination effective as of the fifth (5th) calendar day after the date such notice is given.

Effects of Termination

Unless the Parties agree otherwise in writing, termination of the Agreement shall also serve to terminate all Service(s) and Statements of Work and to cancel all Work Orders. The Customer shall pay DomeneConnect.no all Fees and Expenses earned or incurred by DomeneConnect.no pursuant to such Service(s), Statements of Work, and Work Orders through the date of termination, less any payments made hereunder by the Customer prior to said termination. Additionally, all property of each Party which is in possession of the other Party shall be returned to its owner. In the event one or more Service(s) is terminated prior to the expiration of the Term for such Service(s) (other than due to a material breach of this Agreement by DomeneConnect.no), the Customer shall be responsible for all charges incurred through the date of termination.

Warranties of DomeneConnect.no

DomeneConnect.no warrants that the Service(s) shall be provided in a workmanlike and professional manner. Upon DomeneConnect.no’s breach of the foregoing warranty, the Customer’s sole and exclusive remedy shall be to require DomeneConnect.no to exercise commercially reasonable efforts to repair or replace the nonconforming Service(s); provided, however, that, with respect to any Service(s) which are interrupted or rendered inoperable due solely to DomeneConnect.no’s breach of the foregoing warranty for any time period, the Customer shall also be entitled to a pro-rata refund of any Fees attributable to the interrupted or inoperable Service(s) in an amount determined by multiplying the fixed monthly, recurring Fees (if any) for the interrupted or inoperable Service(s) by the ratio that the number of consecutive hours of inoperability bears to 720 hours (for the purpose of this computation, each month is deemed to have 720 hours). DomeneConnect.no will not be liable to any extent whatsoever for interruption, restriction, inoperability, or malfunction of any Service(s) which is not caused solely by a breach of the warranty set forth in this Section.

EXCEPT AS SET FORTH IN THIS SECTION, DomeneConnect.no MAKES NO WARRANTIES, EXPRESS OR IMPLIED, CONTRACTUAL OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF UNINTERRUPTED OR ERROR-FREE OPERATION AND THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SERVICE(S) OR ANY ASPECT THEREOF, AND ALL WARRANTIES WITH RESPECT THERETO ARE HEREBY EXPRESSLY DISCLAIMED. The Customer expressly acknowledges and agrees that proper provision of the Service(s) is dependent upon the provision to DomeneConnect.no by the Customer of timely and accurate information regarding (i) the Customer’s needs and expectations regarding the Service(s), and (ii) all operational, technological, or other data which the Customer knows or should know is relevant to the provision of the Service(s) (collectively “Information”). The Customer shall provide the Information to DomeneConnect.no in a timely manner, and the Information shall be accurate. The Customer agrees that, in the event of the Customer’s breach of its obligations in this Section, the warranty set forth in this Section shall be null and void.

DomeneConnect.no cannot be held liable for any security breaches. The goal of cybersecurity is to reduce risk, as the complete elimination of all risks is inherently unachievable in the constantly evolving landscape of cyber threats.

Warranties of Customer

Customer hereby covenants, represents, and warrants that: Customer will not, and will not permit others to, use any Service(s) (i) for any unlawful or illegal purpose or in connection with or in furtherance of any unlawful or illegal activity, (ii) in violation of any applicable law or regulation, (iii) in a manner that will, or is likely to, infringe the copyright, trademark, trade secret, or other intellectual property rights of others or violate the right of privacy, publicity, or other personal rights of others, or (iv) in connection with any conduct or activity that is, in the sole opinion of DomeneConnect.no, defamatory, indecent, obscene, offensive, threatening, abusive, hateful, tortious, or violative of the rights of any other person or entity; Customer will not, and will not permit others to, do any act which may interfere with or compromise the security or functionality of any Service(s), including without limitation attempting to probe or test the vulnerability of any system or network connected to or accessible by the Service(s); No equipment owned, leased, maintained by, or controlled by Customer or by any third party which is connected to or utilized the Service(s) with the consent of Customer will (i) interfere with or impair any Service(s) or any plant, services, or facilities of any Indemnitees or of any third party, (ii) unlawfully interfere with or impair the transmission of privacy of any data or communications transmitted over the Service(s) or over any plant, services, or facilities of any Indemnitees or of any third party, or (iii) create, cause, or contribute to the creation or causing of a hazard to any Indemnitees or to any third party.

Indemnification

DomeneConnect.no reserves the right to suspend, interrupt, or terminate any Service(s) or this Agreement immediately without further notice in the event of a breach by Customer of DomeneConnect.no’s AUP. DomeneConnect.no reserves the right to remove, delete, disable, or block transmission of any data or materials which DomeneConnect.no reasonably believes constitute, either alone or in conjunction with other acts, omissions, or data or materials, a breach or potential breach by Customer of DomeneConnect.no’s AUP. Customer agrees to defend, indemnify, and hold harmless DomeneConnect.no, its successors or assigns, subsidiaries, officers, directors, employees, agents, independent contractors, licensees, licensors, suppliers, and customers (excluding Customer) (collectively “Indemnitees”) against any and all claims, liability, loss, damage, or harm (including without limitation reasonable legal and accounting fees) suffered by such Indemnitees (including without limitation claims, liability, loss, damage, or harm in connection with death, bodily injury, or injury to real or personal property) arising from or in connection with (i) Customer’s purchase or use of any Service(s), including without limitation any claims, liability, loss, damage, harm suffered by such Indemnitees arising from or in connection with the use by any third party of any Service(s) purchased by Customer regardless of whether such use was authorized by Customer, or (ii) Customer’s breach of any provision of this Agreement.

The Customer agrees to defend, indemnify, and hold harmless DomeneConnect.no, its affiliates, officers, directors, employees, agents, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorney’s fees) arising from:

a) The Customer’s misuse of DomeneConnect.no’s services;
b) The Customer’s violation of any terms of this Agreement or any applicable laws;
c) Any content uploaded, posted, transmitted, or otherwise made available through the services by the Customer;
d) Any unauthorized access to or use of DomeneConnect.no’s servers and/or any personal information stored therein.

Legal Fees and Damages: The Customer shall be responsible for all reasonable legal fees, damages, and other expenses that DomeneConnect.no incurs as a result of the Customer’s actions.

Prompt Notification and Cooperation: DomeneConnect.no shall provide prompt notice to the Customer of any such claim, suit, or proceeding. The Customer agrees to cooperate fully with DomeneConnect.no in the defense of any such claim, suit, or proceeding.

Right to Defense and Control: DomeneConnect.no reserves the right, at the Customer’s expense, to assume the exclusive defense and control of any matter for which the Customer is required to indemnify DomeneConnect.no, and the Customer agrees to cooperate with DomeneConnect.no’s defense of these claims.

Limitation of Liability

Any other provision of this Agreement to the contrary notwithstanding, the aggregate liability of all Indemnitees for any losses or damage, whether direct or indirect, arising out of or in connection with the Service(s), including without limitation any cause of action sounding in contract, tort, or strict liability, shall be limited to actual, direct damages incurred but in no event shall exceed the greater of (i) One Thousand Dollars, or (ii) the Fees paid by Customer to DomeneConnect.no during the two (2) months preceding the month in which liability arose for the Service(s) in connection with which such liability arose. DomeneConnect.no shall not be liable for lost profits or other consequential damages, cover damages, or for any claims against Customer by any third party, even if DomeneConnect.no was advised of the possibility of same. Under no circumstances shall DomeneConnect.no be liable hereunder for special damages, consequential damages, general damages, incidental damages, indirect damages, or exemplary or punitive damages. No action arising out of this Agreement, regardless of form, may be brought by Customer against DomeneConnect.no more than one (1) year after the cause of action arose. Without limiting the foregoing:

Customer acknowledges that DomeneConnect.no is not responsible for controlling or monitoring any content, information, data, or other materials stored on, transmitted via, or accessible through the use of, the Service(s), and DomeneConnect.no will have no liability to Customer whatsoever in connection with such content, information, data, or other materials (including without limitation the accuracy or suitability thereof or unauthorized access or damage to, alteration, theft, corruption, destruction, or loss of, Customer’s data or other materials); DomeneConnect.no will have no liability to Customer whatsoever in connection with any harm or loss arising from or in connection with unauthorized access to the Service(s); and all Indemnitees are expressly made third-party beneficiaries of this Section 5.

Force Majeure

If either Party shall be prevented from performing any portion of this Agreement (except the payment of money) by causes beyond its control, including labor disputes, civil commotion, war, governmental regulations or controls, casualty, inability to obtain materials or Service(s) or acts of God, such Party shall be excused from performance for the period of the delay and the time for such Party’s performance shall be extended for a period of time equal to the duration of such delay.

Construction, Venue, Jurisdiction

This Agreement and any claim, action, suit, proceeding, or dispute arising out of or in connection with this Agreement shall in all respects be governed by, and interpreted in accordance with, the substantive laws of Norway. Venue for any actions arising under this Agreement shall vest exclusively in courts located in Oslo in Norway. The Customer hereby submits to the jurisdiction of the aforementioned courts, and agrees that it will not assert lack of personal jurisdiction as a defense to any such action. The Customer acknowledges that their attorney has reviewed and participated in the construction of this document and nothing herein shall be viewed as to have favorable construction.

Backup and Data Loss

DomeneConnect.no will not be held responsible for any loss of data held on our servers to Your website. DomeneConnect.no will always try to restore Your lost data, however, this doesn’t always work as the data may be corrupted. In such an instance, DomeneConnect.no will not be held responsible. It is Your responsibility to maintain current backups of Your website data.

Responsibility for Backups: The Customer is solely responsible for conducting regular backups of all their data associated with the services provided by DomeneConnect.no. This includes, but is not limited to, website files, databases, emails, and any other data.

No Liability for Data Loss: DomeneConnect.no is not responsible for any loss, alteration, or corruption of the Customer’s data. In the event of any data loss or system failure, the Customer’s ability to restore their data will depend entirely on the backups they have maintained.

Recommended Backup Practices: While DomeneConnect.no provides automatic backup services as part of its hosting solutions, customers are strongly encouraged to maintain their own backups. This practice is recommended as an additional precaution to safeguard against data loss. Customers should regularly create independent backups of all their data associated with services provided by DomeneConnect.no. This includes, but is not limited to, website files, databases, and emails. It is advisable for customers to store their backups in a secure, remote location separate from their primary data storage. This ensures data integrity in case of localized issues affecting the primary data source. Customers should perform these backups at a frequency that aligns with their operational requirements and data recovery needs, ensuring minimal data loss in case of a recovery situation.

Assistance in Data Recovery: While DomeneConnect.no may provide assistance in data recovery, success is not guaranteed, and such assistance may incur additional fees.

Consequences of Not Backing Up: Customers acknowledge that failure to maintain regular backups may result in irretrievable data loss and that DomeneConnect.no shall not be held liable for any such loss.

Waiver

No waiver of any right or remedy shall be valid unless in writing and delivered to the other Party, and waiver of a right or remedy on one occasion by a Party shall not be deemed a waiver of such right or remedy on any other occasion.

Web Application Firewall (WAF) Integration

At DomeneConnect.no, we prioritize the security and integrity of our hosting services. As part of our commitment to providing robust security measures, we include an integrated Web Application Firewall (WAF) as a key component of our solution. This WAF is designed to provide a high level of protection against common web threats and vulnerabilities, ensuring a secure hosting environment for all our clients.

We wish to inform our clients that our WAF is implemented as a community setup. This approach allows us to leverage collective security insights and provide a strong defense mechanism against a wide array of security threats. The community setup of our WAF is a critical factor that enables us to offer our services at a competitive price point, making advanced security measures accessible to our diverse clientele.

Due to the nature of this community-based WAF integration, customization options for individual clients are limited. While this setup ensures a robust and well-maintained security layer, it may not accommodate highly specific or unique customization requests. We believe that this approach strikes an optimal balance between offering effective, broad-spectrum security and maintaining cost-efficiency for our clients.

Clients with specialized security needs or requiring extensive customization of their WAF setup are encouraged to discuss these requirements with our team. While we may not be able to fulfill all customization requests due to the community nature of our WAF, we are committed to understanding and addressing our clients’ security concerns to the best of our ability within the framework of our service offering.

Scope of Support Services

DomeneConnect.no is committed to providing high-quality support to our clients, with a primary focus on addressing technical issues directly related to server performance and stability, which fall under the natural responsibility of hosting services. Our support team is dedicated to ensuring that all server-level technical aspects of our services function optimally and align with our standards of service excellence.

Beyond these core technical support responsibilities, DomeneConnect.no may, at its discretion, offer additional support in other areas. This extended support is subject to the availability of our internal resources and is provided on a case-by-case basis. The decision to offer such support is influenced by factors including, but not limited to, resource availability, the nature of the client’s request, and our assessment of the potential benefit or relevance of the support to the client’s needs.

Clients should be aware that while DomeneConnect.no endeavors to assist in a broad range of queries, any support provided outside of the primary scope of technical server-level issues is offered as a courtesy and is not an obligatory aspect of our service agreement. As such, the availability of this extended support cannot be guaranteed and may vary depending on our current operational capacity and business priorities.

We encourage our clients to communicate their needs clearly, enabling us to assess and respond to support requests effectively. However, clients are advised to seek external professional assistance for issues that fall outside the domain of standard technical server support, particularly for specialized or complex matters that are beyond the scope of our hosting services.

SEO Consulting Services

DomeneConnect.no provides Search Engine Optimization (SEO) consulting services based on current best practices and our professional expertise. Clients acknowledge that SEO is a dynamic and evolving field, and that DomeneConnect.no makes no guarantees regarding the specific outcomes or results of any SEO strategies or recommendations provided.

SEO effectiveness can be influenced by many factors outside of DomeneConnect.no’s control, including changes in search engine algorithms, competitors’ actions, and the client’s website history and content. Therefore, while DomeneConnect.no commits to applying its best efforts and industry knowledge, we cannot guarantee specific rankings, traffic increases, or other specific outcomes from our SEO consulting services.

Clients agree that DomeneConnect.no shall not be held liable for any changes in search rankings, website traffic, conversions, or any other SEO outcomes, as these elements are subject to numerous variables beyond our control. Clients also acknowledge their responsibility to provide accurate and truthful information regarding their website and business practices as they relate to the SEO services provided by DomeneConnect.no.

By using DomeneConnect.no’s SEO consulting services, clients agree to release and hold harmless DomeneConnect.no from any liability, claims, losses, or damages arising from or in connection with the implementation of any strategies, advice, or recommendations provided as part of our SEO services.

Compliance with Data Protection Regulations

While DomeneConnect.no is committed to complying with all applicable data protection laws, including the General Data Protection Regulation (GDPR), clients are solely responsible for ensuring that their use of DomeneConnect.no’s services is in compliance with all relevant data protection regulations. This includes, but is not limited to, the GDPR and any other applicable local, national, or international laws regarding data protection and privacy.

Clients must ensure that any personal data they collect, process, or manage using DomeneConnect.no’s services is done so in accordance with the requirements of these laws. This responsibility includes obtaining all necessary consents, providing required disclosures, and implementing appropriate security measures for the protection of personal data.

DomeneConnect.no shall not be held liable for any client’s failure to comply with data protection laws and regulations. Clients agree to indemnify and hold harmless DomeneConnect.no from any claims, fines, penalties, or damages incurred due to the client’s non-compliance with such regulations.

Legal and Compliance Consulting Services

DomeneConnect.no offers consulting services related to cookie compliance and other legal-related matters for informational purposes only. Clients acknowledge and agree that these services do not constitute legal advice and should not be relied upon as a substitute for legal counsel. DomeneConnect.no is not a law firm, and our employees, agents, and contractors are not acting as your attorneys.

While we strive to provide accurate and up-to-date information, the field of legal compliance, including cookie compliance, is subject to frequent changes and can vary greatly depending on specific circumstances and jurisdictions. Clients are responsible for conducting their own legal research or seeking independent legal advice to ensure that their actions and practices comply with applicable laws and regulations.

Clients agree that DomeneConnect.no shall not be held liable for any decisions made or actions taken based on the consulting services provided. Clients further agree to indemnify and hold harmless DomeneConnect.no from any and all claims, damages, losses, liabilities, costs, and expenses arising from their reliance on any information provided as part of our consulting services.

By using DomeneConnect.no’s consulting services, clients acknowledge and agree that they are responsible for their own compliance with applicable laws and regulations, and that they will not rely on DomeneConnect.no’s consulting services as legal advice or as a substitute for legal counsel.

Integration

This Agreement, including all referenced or attached exhibits, schedules, attachments, or documents, sets forth the entire agreement and understanding between the Parties pertaining to their subject matter and supersedes all prior or contemporaneous discussions, agreements, promises, or understandings between the Parties. Neither Party shall be bound by any conditions, definitions, warranties, understandings, or representations with respect to such subject matter other than as expressly provided in this Agreement.

Superior Agreement

This Agreement shall not be supplemented or modified by any course of dealing or trade usage. Addition to or variance from the terms and conditions of the Agreement by Customer, including without limitation any additional or varying terms contained in Customer’s preprinted forms, correspondence, or other documents transmitted to DomeneConnect.no, shall be of no effect, unless otherwise expressly provided in the Agreement.

Assignment

This Agreement is not assignable by Customer, in whole or in part, voluntarily or involuntarily, including by operation of law or by merger in which Customer does not survive, without DomeneConnect.no’s prior written consent. Any attempted assignment without DomeneConnect.no’s written consent shall be null and void.

Notice

Unless otherwise agreed to by the Parties, all notices required under the Agreement shall be delivered in writing, addressed and sent to the address provided herein and to the attention of the Party executing the Agreement or the person’s successor, by either (i) registered mail, (ii) certified mail, return receipt requested, or (iii) overnight mail, or (iv) by telephone facsimile transfer (v) email that is replied to as accepted – appropriately directed to the attention of the Party executing the Agreement or that person’s successor. Unless otherwise agreed to by the Parties, all notices required under the Agreement shall be deemed effective when received.

Severability

If any provision of the Agreement is held invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain in full force and effect.

Counterparts

This Agreement may be executed in multiple counterparts, each of which shall be deemed an original and all of which taken together shall constitute one and the same Agreement.

Venue

The customer agrees that the exclusive venue for litigation shall be in Oslo in Norway. All lawsuits shall occur here and the customer agrees that any judgments may be domesticated to their local court of appropriate jurisdiction to enforce the judgment.

Acceptance

Payment of the customer of the first month’s fees shall constitute acceptance of this agreement. This agreement shall be modified from time to time by DomeneConnect.no, and the then-current version shall be posted on the DomeneConnect.no website on this url https://DomeneConnect.no/terms-of-service/. If the customer does not agree to the new terms – the customer should cease utilizing the services at the next term after cancelling the service according to the cancellation terms.

If you are terminated due to a violation of our terms of service, you agree that you will not receive any partial refunds and that this shall be considered a reasonable estimate of the liquidated damage and not a penalty.

Acceptable Use Policy (AUP)

This Acceptable Use Policy applies to all persons and entities (collectively, “customers”) using the products and services of DomeneConnect.no, including Internet service. The policy is designed to protect the security, integrity, reliability, and privacy of both the DomeneConnect.no network and the products and services DomeneConnect.no offers to its customers. DomeneConnect.no reserves the right to modify this policy at any time, effective immediately upon posting of the modification. Your use of DomeneConnect.no’s products and services constitutes your acceptance of the Acceptable Use Policy in effect at the time of your use. You are solely responsible for any and all acts and omissions that occur during or relating to your use of the service, and you agree not to engage in any unacceptable use of the service.

Prohibited Uses

Unacceptable use includes, but is not limited to, any of the following:

  • Posting, transmission, re-transmission, or storing material on or through any of DomeneConnect.no’s products or services, if such posting, transmission, re-transmission or storage is in violation of any local, state, federal, or non-United States law or regulation, or is threatening, abusive, or defamatory.
  • Installation or distribution of “pirated” or other software products that are not appropriately licensed for use by customer.
  • Deceptive marketing practices.
  • Actions that restrict or inhibit anyone in their use or enjoyment of DomeneConnect.no’s products and services, or that generate excessive network traffic through automated or manual routines not related to ordinary personal or business use of Internet services.
  • Introduction of malicious programs into the DomeneConnect.no network or servers (e.g., viruses, trojan horses, and worms).
  • Causing or attempting to cause security breaches or disruptions of Internet communications. This includes actions such as accessing data not intended for the customer, logging into a server or account without authorization, port scans, flood pings, packet spoofing, and forged routing information.
  • Executing any form of network monitoring that will intercept data not intended for the customer.
  • Circumventing user authentication or security of any host, network, or account.
  • Interfering with or denying service to any user other than the customer’s host (e.g., denial of service attack).
  • Using any program/script/command, or sending messages of any kind, designed to interfere with, or to disable, a user’s terminal session.
  • Furnishing false or incorrect data on the order form contract (electronic or paper) including fraudulent use of credit card numbers.
  • Sending unsolicited mail messages, including “junk mail” or other advertising material to individuals who did not specifically request such material (E-mail “spam”).
  • Unauthorized use or forging of mail header information.
  • Creating or forwarding “chain letters” or other “pyramid schemes” of any type.
  • Use of unsolicited E-mail originating from within the DomeneConnect.no network to advertise any service hosted by DomeneConnect.no or connected via the DomeneConnect.no network.
  • Exporting, re-exporting, or permitting downloads of any content in violation of the export or import laws of the United States or without all required approvals, licenses, and exemptions.
  • Storing personal information of GDPR countries without allowing clients to remove that personal information anytime they wish.
  • Sites that don’t require parental consent when minors of GDPR related countries enter personal information.

Plugin and Add-on Usage Policy

  • Regulation of Plugins and Add-ons: DomeneConnect.no reserves the right to regulate and restrict the use of certain plugins and add-ons on the Customer’s website hosted on DomeneConnect.no’s servers to ensure the security, stability, and integrity of our hosting services.
  • Prohibited Use of Nulled or Pirated Software: The Customer agrees not to upload, install, or use any nulled, cracked, or pirated copies of themes, plugins, or any other software on their website. The use of such unauthorized and illegal software is strictly prohibited and is a breach of this Agreement.
  • Security Compliance: The Customer must comply with all security measures and guidelines provided by DomeneConnect.no and use only legitimate and authorized plugins and add-ons. This includes regular updates and adherence to software licensing agreements.
  • Consequences of Non-Compliance: Any violation of this policy, including the use of nulled or pirated software, may result in immediate corrective actions by DomeneConnect.no, which may include disabling the non-compliant software, suspending the Customer’s hosting services, or terminating the Agreement.
  • Customer Responsibility for Software Legality: The Customer is responsible for ensuring that all themes, plugins, and add-ons used on their website are legally obtained and properly licensed. The Customer is liable for any legal consequences of using pirated or unauthorized software.

Password Policy

The client is solely responsible for not uploading unsafe plugins/add-ons to the website and for using good password practices, which include the following:

  • Long passwords – a minimum of 7 characters
  • Always combine letters, numbers, and symbols
  • Do not use birth dates, family names, or other personal information
  • Avoid words that are in common usage – in any language.
  • Avoid sequences or repetitions such as ‘abcd’, ‘1234’, or ‘666’
  • Do not use the same password as for other systems like Gmail or Facebook.
  • Change passwords regularly
  • Do not store passwords in places where they can be discovered by unauthorized persons
  • Never disclose your password to anyone who calls or asks for it via email – no matter what!
  • Do not store your password electronically
  • Use two-factor authentication

Enforcement

DomeneConnect.no may immediately suspend and/or terminate the customer’s service for violation of any provision of this policy upon verbal or written notice. Prior to suspension or termination, DomeneConnect.no attempts to work with customers to cure violations of this policy and ensure that there is no re-occurrence; however, DomeneConnect.no reserves the right to suspend or terminate based on a first offense. Electronic Communications Privacy Act Notice

DomeneConnect.no makes no guarantee of confidentiality or privacy of any information transmitted through or stored upon DomeneConnect.no technology, and makes no guarantee that any other entity or group of users will be included or excluded from DomeneConnect.no’s network. In addition, DomeneConnect.no may periodically monitor transmissions over its network for maintenance, service quality assurance, or any other purpose permitted by the Electronic Communications Privacy Act, P.L. No. 99-508, as amended.
